I've received an infringement notice for doing over 100km but not more that 113km in a 100km zone...
The photo taken has a date and time of the offense on the top of the photo.
I wasn't on the road on that day.... I was at work.
Is this grounds for the ticket being cancelled?

Pretty much.

Is the photo of you in the car?

Who was driving the vehicle at the time of the ‘offence’?

Not disputing that it's my vehicle...
I'm wondering if the date isn't correct on the infringement notice... how do I know anything else on the speed camera trailer was actually calibrated and working correctly...

Can you prove you weren’t in the vehicle at the time of the offence on the infringement notice?

There’s a couple things that police need to be able to prove to charge someone.

Time
Date
Place
And a person...

If they cannot prove that at such time on such date in such place, then they cannot prove the elements of the offence.

Well it's my vehicle in the photo.... no question about that.... just on the wrong day and I'm wondering if all of the other information is correct ... like if the speed that was recorded was accurate also...
So it's worth defending...
Thank you James
I'll start looking for a law firm to talk to...
