A week ago I was in a car accident. An elderly driver drove into the rear of me.
The police attended, and confirmed the other driver was at fault.
My insurance will not cover my car, and she will not contact her insurance. She may or may not be insured, she will not speak to me now.

She says "She knows she is not to blame" and has been told not to talk to me.

I really don't know how to proceed.

What reason is your insurance company giving you?

In the meantime ask the police for a copy of the accident report so you can get name and address of the other driver.

I dont have property insurance on my own car. She is in the fault, and has third property property but will not use it as she doesn't want to pay the excess.

If the matter goes to court and you win - yes.

Otherwise it is by agreement - she agrees to pay less now than have the matter go to court and pay more.
