I am a dual national of Pakistan and Australia.I got married in 2011 in Pakistan and my wife came to Australia. Unfortunately, our marriage did not last and I got a divorce November last year. I want to marry again in Pakistan and bring my new wife to Australia.

Will there be any issues under Immigration Law?

Hi Muhammad,

You may not be eligible to be a sponsor for your partner, if you sponsored another person for migration to Australia on a Partner or a Prospective Marriage visa in the last 5 years.

Actually, I got the visa 176 (skilled-sponsored )in 2014. My sponsor was my ex-wife's aunt. I was the main applicant.

Am I eligible to sponsor my new wife?

Who was your wife's sponsor? If you didn't sponsor her and you have Australian permanent residency or citizenship then I don't think it would be an issue. Perhaps an immigration expert could confirm this?

My ex-wife's aunt, who is an Australian citizen, sponsored both of us.

One more question, please!

If I can sponsor my new wife, would it be ok if I apply for her Prospective marriage visa rather than partner visa?
