Unlikely in NSW.

Even if it was legally obtained evidence the Family Court knows many people set-up their ex and their attempt to use a recording backfires on the person who made it.

In fact, this can be an offence in itself.

The court is not obliged to admit it into evidence, and tends to take a cautious view about whether or not to do so. Have a read of this.
