VIC Possible to Find Out If Someone has Family Violence Intervention Order?

Hi all,

I'm in the very early stages of a relationship and am wondering if it's possible to find out if someone is subject to a Family Violence Intervention Order, like some kind of register? He's told me that "it's all in the past" but I'd like to know for sure. He's previously had FVIOs taken against him by his ex-wife and his child.

Nope - there is a right to privacy. Now I'm assuming he accepted without admission? You need to realise that AVO's are granted based on 'the grounds of probability" not 'beyond reasonable doubt. So the threshold is very low.

My ex took an AVO against me and I have to tell you that when I saw her statement, I was shocked that the cops took it seriously. It is widely accepted that AVO's are used to gain leverage in family law matters.

Hey, this bloke has been honest with you - how would you feel if you found out about this through a third party in a year or so?

That said, if you feel threatened or intimidated, get out.

I understand why you wish to check this out. Sammy01 is correct in stating due to privacy act you would not be able to find out through court registry office. However, tho AVO's are evidently easy to place on anyone - that is a temporary AVO.It is far more difficult to place a permanent AVO which lasts for 2 years and you have to reapply prior to the end of the 2 years if you wish for it to continue.

The Temp AVO gives a date to appear in court to defend yourself against the AVO statements that a partner or member of the family has placed on you. There are two ways of finding out whether the person you have begun to see has an AVO and that is to enquirer at the police station or ask him to have a police or Criminal history check. Otherwise, his family or friends will tell you.

Always trust your instincts! It is faster and more accurate than anything else. Otherwise, if in doubt- get out!
