Hi

My ex-husband has put a property settlement case in VIC whereas both of us stay in NSW. He is the bullying kind and has taken the plea that since his lawyer is in VIC, he filed the case there.

Is there a way that such a case can be transferred to Federal Circuit Court, NSW because all the parties concerned stay in NSW?

You can request in your first mention that the proceedings be transferred to a the Federal Circuit Court at the most appropriate location (Parramatta, etc). It's likely the judge would transfer it anyway, but make sure you request a transfer just to be sure.

Jut one small follow up: I will have to travel to Melbourne for the hearing or is there something that I can do in the interim to transfer the case?
