VIC Son Addicted to Drugs - Get Restraining Order?

My 21 year old son is an ice addict (drugs). Is there any type of restraining order I can get to have him removed from my place of residence as he will not leave?

You may be able to apply for an apprehended violence order, or an 'exclusion order' - which requires your son to move out of home and can also prohibit him from approaching the property. He can be charged by the police if he disobeys the order.

i spoke to the police a year & half ago told me if he was violent they would be able to remove him from the house. Problem is he is not violent yet but i am scared as i live on my own & have a younger son with people coming to the house to try to get money my younger son does not like to be home on his own. Is there an order i can get to remove him even if he is not violent because he is actually putting my son & i in danger every time he owes money

You can apply to the court yourself for an Family Violence Intervention Order. You will have to tell the court why you need it....why u r scared of him in regards to you and your younger son's safety and welfare.

You may find it hard to get if you can't show he is a threat to you.

However you own/rent the house, you can kick him out without an order.

Thank you for your reply can i get the forms on line? I am renting and have told him to leave numerous times and only goes for a few days and is back. So I really need something to show him that he must leave. Find it very frustrating that my 21 year old son who pays nothing and is an addict seems to have more rights than me
