In terms of the contract wording:
- If you are referring to their application, it was discontinued - so there’s no actual or threatened application.
- if you are referring to your application, it would depend on the nature of the application as to whether or not it would ‘affect the property’. It’s only those that need to be disclosed. Simply suing a person, for example for breach of contract, would not raise the clause’s operation on its wording. The same with any threatened action.
