Hi all,

My brother just started to do online business buying and selling things online. He bought from different suppliers and sell to different platforms, Wechat, Facebook, Gumtree etc. One of my friends told me that he must register his business and get an ABN number, otherwise it is considered illegal underocommercial law to register his business and there were people who get caught. Is that true?

If he is operating a business he will need an ABN. An ABN is free when you register with the Australian Business Register.

When you register for an ABN you can:
  • register for GST and a business name at the same time
  • get an AUSkey to transact online with government agencies
  • be endorsed as a deductible gift recipient or an income tax exempt charity.

Alternatively to the information provided above he could register a company with ASIC. Although strictly from a practical, business point of view if he venture is relatively new one would usually start as a sole trader.
