A new spouse does not automatically acquire rights to property you co-own with your ex but leaving that co-ownership unresolved creates ongoing risk, particularly if circumstances change on either side. The cleanest approach is to finalise the property settlement with your ex through Consent Orders first. If you are remarrying, a Binding Financial Agreement with your new partner is the most direct way to protect what you are each bringing into the relationship. Worth speaking to someone experienced in pre-nuptial and financial agreements sooner rather than later.

Found this while browsing and wanted to add my two cents. Have you considered a prenuptial agreement with the new partner? It can further secure your assets and ensure everyone is on the same page. Also, how's everything going with the property settlement? It’d be great to hear updates from others in a similar boat.
