Hi,

If you call an insurance company regarding a claim against you, and the operator says that the call will be recorded, if you refuse for them to record the call, is it legal for them to continue to record?
Just wondering the legalalities regarding your personal privacy in these matters.

Regards,
Si

Yes. Your right is to stop talking.

I see it's been a while since you’ve posted, but I just wanted to ask if anyone’s had luck getting clear answers from a lawyer or the OAIC on this. A lot of grey areas stay grey unless someone pushes for a proper ruling. Also curious—has anyone here been through a case where a recorded call was actually used as evidence? Wondering how that played out legally and practically.

I’ve used activecalls, and one helpful thing is that it lets you manage call recordings securely while still following local privacy rules. It clearly shows which calls are recorded, and you can set permissions so only certain people access them. I had clients in different states, so having those settings helped me stay compliant without needing to check every call manually.
