I took a person to the Small Claims Tribunal (SCT) back in 2008. I was issued an Order of the Tribunal for the full amount, however, the person did not pay within the 28 days and refused to negotiate. I requested an oral examination of her financial circumstances on behalf of the SCT and found the person was in a bad way financially (they claimed so, anyway). They've since got a job and done some travelling, so I would like to enforce the order through the courts now that they can't fabricate their financial position.
I was told at the time that orders from the SCT last for 10 years. Is this correct? I've heard conflicting reports that this was changed to 7 years.
Can someone please confirm this? The order is from the Small Claims Tribunal in QLD (prior to QCAT) and doesn't have an expiry date on the order.
