Good Morning,



I have sold my apartment in Victoria last week. The purchaser’s solicitor is holding $5K in a trust account due to the neighbor’s downstairs made a complaint to them that there is a leaking in their apartment that is coming from my apartment. The leak was fixed about 4 months before selling the apartment and apparently the leaking is occurring again. So, the neighbor emailed the purchase’s solicitor and said to them the leaking is still occurring, so the settlement took place but $5K was not paid to me, as this is to be used for the leaking as per the general condition clause 24.4. I would like to know if someone can help with the following:



Who should inform to me the works to be carried out in the unit?

Will I have the opportunity to give my opinion whether the works to be carried out will solve the issue or the amount to be paid is too high for instance

What will happened if the amount to be paid is over $5K

After I paid for the leaking, what will happen if the leaking is occurring again.
