What if there is never an agreement? Will the judge then make the orders on what she sees best for custody arrangements?

When you filed your paperwork you should have asked for Interim Orders and Final Order.

At your "Interim hearing" Judge/Registrar will make Orders about where the child spends their time until your Final Court date maybe 2 years in the future.

After your family report you would expect to be having an interim hearing were you will get those Orders.

Then way in the future if you cant work it out you will have your final trial and Judge will decide the final verdict. 99% of people don't get here as it's sorted out long before so ignore this for now.
