Employer Not Lodging Visa Nomination - Unlawful?

    I just want to know if it is unlawful for an employer to just asked my friend to work everyday but not lodging his visa nomination for him. He always said he will do it "tonight" but its been 2 weeks already and my friends visa will expire next week. He's not even sure now if his employer still wants to nominate him or just using him until his visa expires.
