Our permit allows to add new 450mm trellis on the existing 1750mm fence, to a total height of 2200mm. After long discussions, we agreeded to renew the fence as the old fence was rot and damaged. It was not feasible to add 450mm new trellis on top. Our neighbor agreed and paid about one third of the cost and we paid the rest. But on completion of the renewal the neighbor changed his mind and filed a complaint to local council. Council stepped in and sent me a contravantion notice. Accused us no building permit. Is it correct by council?

Some councils require that you apply for approval before erecting a fence, or a fence over a particular height. Did you check if that is a requirement of your council before erecting?

Thank you for the reply. Our permit is council issued planning permit, and consequently building permit from our RBS, a private firm. Do we need to apply again to build the fence? Thank you!

In that case it's a mystery. Obviously someone has got somersetting wrong.... If you have a planning & building permit from council, AND it was erected as per the plan, then what is council saying you have contravened?

The permit is a site development of units. And the fence concerned is to add to the old existing a new trellis to a height of 2.2m in total. But the existing one is too old rotted and damaged. Not safe to do so. Neighbor and us all agreed to erect a new same structure of timber raling fence to the height of 2.2m. What is wrong with us? Thanks!

I think you are going to need to have the council explain exactly what the problem is or have a professional look at all the paperwork to see what's going on.
