If you are given default judgement with multiple (3) defendants for a single sum as assessed, (i.e. not a specific debt for each defendent) how do you go about deciding how it should be split?

Can you just enforce against whichever defendant you wish? Do you have to split it three ways? How does it work?

Does this mean you won a case?

Can you just enforce against whichever defendant you wish?

Yes, the party easiest to extract the money from.

Thanks Rod. Do you need their bank account number to garnishee, or just the bank's name?

Hi Rod,

I had already viewed that.

I still was not sure if you needed their account or just the bank?

I have the bank, just not the account.

If it is a business, name and ABN is normally sufficient.

For an individual full name and address.

Alternatively, you can send them an examination notice under NSW rules.

BTW, is this action related your previously posted issues or something new altogether.

BTW, default judgements can be appealed. On what date did you get the judgement?

How long do you have to wait/should you wait after default judgement?

Thanks in advance.

I don't think there is a set time, just the longer the other side takes the harder it can be to overturn. Start recovery anyway.
