My partner went to the police station and made a statements against me. The police officer put me on a protection order and there is a court case today. My partner and I have resolved the issue and want to know how to drop the order, and what will happen under Criminal Law if I do not attend the court case today?

Hi,

My understanding is, in QLD when a the police are the applicant of the protection order, your partner has no power to stop the order from proceeding. I really hope you attended court today or you will probably find the order went through uncontested.

If I had of seen this earlier, I would have said to attend and tell the Magistrate that disagree with the order and the Magistrate would likely set a hearing date. Then at the hearing you would need to prove that anything raised in the protection order wasn't an issue. Please let me know how you went.
