Our 23-year-old daughter passed away in July 2015 and owned a car registered in her name and also a vehicle which she purchased privately a few days before her death which is not registered in her name. She passed away before lodging transfer papers with the QLD transport department. The vehicle registered in her name was left at a friend's home and the friend is not willing to relinquish possession.

The vehicle purchased just before her passing is in our possession and is still registered to the previous owner. The previous owner made an attempt at claiming the vehicle was not paid for and contacted the local police. The car registration has now expired and we are seeking guidance as to how we can register the vehicle or sell it so her 3 children can have the funds. Our daughter did not have a will.

Please help.

I'm in Victoria, but the process is likely to be similar for you in QLD. You will need a legal proof of death before you can transfer the vehicle - this is usually the death certificate.

Go to your local Department of Transport, or look on their website - they will have the information you need.
