Long story short: My mother beat up my sister. My sister didn't press charges. My mother took advantage of this and filed for Intervention Orders against the entire family on a fake story she made up with zero proof. At court I was lied to by VLA and was coerced into consenting to an IVO without admission and now its on my record, destroyed my life and has caused me severe psychophysical trauma.

On top of this: She lied she was the owner of my home, and I was charged for being in my home and refusing her entry (she had no access). I was charged a second time when I confronted a burglar breaking into my home.

So in a nut shell: I'm only 23yrs old and have a now pointless Bachelors of Criminology and Justice. I've never done anything wrong in my life, never got into trouble with the law yet alone at school. Now due to my mother beating my sister's head in and lying to the courts about the incident and now taking my own home, furniture and pets from me and destroying my life at such a young age, I don't know what to do.

I tried to appeal my IVO in the County Court but the Magistrates Court stuffed up and gave them the wrong case number and my appeal was thrown out. Now because its outside of 30 days, I'm now stuck with a fake IVO, 2 completed Diversions, and bad record and will now lose my house, pets, furniture etc. to my mother who is now super happy, living it up and got away with perjury. I had evidence about the incident but the court didn't want to hear it, the whole contested hearing was one-sided, literally my mother was on the stand for 2 days and the court never gave the other 3 parties a chance to give evidence and have their say and now my life is over just as I began to enter my adult years.

So, is life over? Or is there something I can do about this? I've been wronged and punished by courts over literally a fairytale, I have troubles sleeping at night knowing how EASY it is for things like this to happen.

What sickens me the most is, my sister, who was the victim, apologises to me and blames herself. This is not on and absolutely disgusting. I've even tried to contact the media but nobody wants to hear it. My story is an example of our crappy court system FAILING.

just checking? your mum is living in your home? Was that the case before all this started?

Apparently she hasn't lived in my house since I was forcibly removed by a piece of paper.

Prior to that? Due to her excessive violence 4-5 years ago, I asked her nicely to leave (with police). Since then she's only been visiting.

My local postie has been at my address more than her over the past 4-5 years to put that in perspective.

The dummies at the police station and the court ruled in her favour because:

1. She's a woman
2. I'm 23 and she's almost 50

So me being a young male, I guess nobody believes me. It's laughable because I provided titles, rates, bills, ambulance reports etc. and they didn't give a toss.

So... I'm a criminal with an IVO BECAUSE my mother bashed my sister's head in. Let's let this sink in for a moment. And to put the icing on the cake, I wasn't even in the house when it happened!

To add insult to injury... A man who was in the same position as me, got his name cleared, all charges removed, and made VicPol have to pay him $60,000. And he actually assaulted someone.

Me? I did nothing, got my life destroyed and now she's gunning for my house, claiming my dad forced me to buy it as it was supposed to be hers and she's using the IVO against me.

If you have such qualifications, why are you in this forum seeking advice ?

Sorry but your story just doesn't add up to me, and i know very little about law, and you even seem to be very vague about what really has transpired.

Did you have a lawyer, because if you did, he must have been one hell of a dummy (sorry) because no lawyer is going to let your mother just TAKE YOUR HOUSE if you own it, especially more so if she was not living in that house prior to all this, but even if she was, how could she get ownership of your house even if she did lie her face off in court.

Me thinks you are not being honest here, it just smells a little bit off to me, and i think you need to go find yourself a proper, qualified lawyer who specializes in this sort of thing.

Sorry but none of it makes any sense, and just offering my opinion.

Ok let me clear something up for you.

My qualifications do not make me a lawyer. You need a law degrees and other qualifications to specialise in whatever area you want to be a lawyer in.

My qualifications relate to the study of criminals, touch on psych, touch on legal process through the courts, criminal intelligence and enforcement agencies.

And no. I'm in this position because:

a) A certain police precinct is corrupt. I had proof of that. Body cam footage was conveniently deleted upon investigation before an incident happened in front of two officers who are conveniently refusing to comment on an event that transpired before them- despite acknowleding the criminal conduct and saying they will investigate and press charges- its been 6+ months and this person has not been charged.

b) Despite being protected by IVOs as a minor, a prosecutor said they'd consider cross IVOs against me and my mother due to a history of violence. I was the victim of her violence and had IVOs against her but she was allowed to have one against me simply because in this day and age "I'm a risk to her given my age and gender". Me and the siblings were victims of sexual and physical violence from our mother yet she needed to be protected from us. Makes no sense. Obviously the gender and age cards were at play with regards to that decision.

c) I'm currently in the Family Court fighting to get my house back and hopefully have her charged for perjury as she had sworn under oath that she owned my home and not me (obviously the court believed a 45+ yr old over a 20 yr old). I showed land titles to prove I was the sole owner and rate payer but the Magistrate conveniently got sick and we had another 'last minute' Magistrate assigned on the day who took our case and basically literally said he didn't have time for my families 'rubbish' and that our Interim conditions would remain. The Barristers jumped up and down but the prosecutor and Magistrate said that they don't want to hear about the property. So who bogus Interim IVO and conditions remained, alongside my legit one though I'm banned from living in my own house and she's not.

d) She produced an image of fake make-up and black and white image (very low quality to hide the fact it was fake). She claimed I assaulted her when I had police attend when she assaulted me. Police noted I was injured and she wasn't. HOWEVER, like my useless VLA Lawyer said, due to the crappy Magistrate who didn't want to hear our case, she gets to WALK AWAY UNPUNISHED with whatever she said and there's nothing we can do about it.

This country's IVO system is broken and so easily exploitable (well in Victoria its crap, if I were in NSW I bet my mother would have been charged for misleading police and courts and providing false and fabricated information). One thing I learned in Uni, youth and men commit suicide over being wrongfully accused and have their lives destroyed by a piece of paper. Women who are ACTUALLY AT RISK, ARE STILL MURDERED AND OR ABUSED because a piece of paper offers NO PROTECTION because ACTUAL abusers and killers don't care.

I'm sick of women being the focal point of domestic violence. Young men like me (and the kid me and my kid siblings and father) are victims of abuse by the hand of someone we refer to as our own mother but we're ignored and are instantly asumed to be the aggressors because of our ages and genders. It's disgusting. My sister and I have put up with violent borderline molestation, the only help we get is from shrinks. Police and courts don't care about us because we were teenagers and now young adults and instantly believe the 45+ yr old woman's stories- despite proof to the contrary. One police officer once told me to grow up and said he doubted that kids our age could be abused by our own mother. -THIS is what is wrong with our country.

Anyone can be a victim, no matter what age or gender. Anyone can be a criminal too. This type of lazy, discriminatory attitude from our police and the courts are beyond WRONG. And this is the cause of that 'problem' these so-called experts cannot figure out.

I agree and sorry for the situation your mother put you in. Look up court of appeals and I think there’s a grant that you can use to fund appeal. But I also am concerned at how your mother can just tell a court she owns the house with no documentation..as we too are dealing with a situation with our house and making sure that this person who won’t leave can’t take possession.
