Hi there, bit of a strange one but I am sure it must have happened somewhere before...
A situation occurred where 3 people were charged as co offenders, with the same charges. They faced court together originally then one of the co offenders was moved to another hearing date and only was charged with one offence where the other 2 remained together with over 100 charges each. Problem was that the 2 with all of the charges had acted under duress in fear for their lives and their childrens being forced to commit crimes by the co offender with 1 charge. The 2 pled guilty, again under duress in fear still of the co offender. Both were convicted and sentenced to a Cco. Is there any way to have this conviction overturned if the co offender admits that he had been forcing the other 2 to act and plead guilty?
