I tried looking up the answer and I found that police can arrest you on private property for drugs without a warrant if they reasonably suspect that you will hide or dispose of the item. Not sure its correct so here's what happened.....

Ex partner pulled into driveway and police immediately pulled up behind him. Because it's his second time for possession with intent to sell or supply he was sent to jail.
Apparently because the property entrance gate is recessed, making it possible to fit a car between that and the property boundary line, the arrest was illegal as he was on private property.
His lawyer is saying that the judge will/has to throw out the charges.

So is it illegal or can police carry on with the charges as they had reasonable suspicion he had drugs and would hide or dispose of them?
He hasnt entered a plea yet and apparently has a bail hearing Friday when the judge is apparently throwing it out.
