Hello. I am currently in a job, however, due to the physical nature of the job, I have injured my shoulder. I am currently off work and it will be a long term recovery as per my doctor. Although I am able to return to light duties, while I am on light duties, am I able to look for other work under employment law?

I am aware of a job at a separate company that I could work for where the physical component is minimised and potentially avoid long term damage to my shoulder, however, if I leave I do not want to negate any possible medical expenses Workcover /my employer would cover, such as regular check ups, specialist appointments, etc.

Hi Toughman101,

I would be very careful how you proceed, because resigning with the employer through which you have a workers comp claim can breach your statutory obligations under that claim and cause your payments and rehabilitation program to cease. I would speak with a lawyer about your personal circumstances and they can tell you how to do it without compromising your rights.
