Hi,

My partner was recently charged with common assault - he is currently serving an ICO (in which he has only served 11 months of a 24 months). What are his chances of going to jail because of this charge?

His previous charges were for aggravated break and enters and was looking at 5 years before his barrister worked her magic and the judge granted him the ICO.

Depends on a variety of factors, too many of which to list here. How serious was the assault he is currently charged with? What other convictions does he have in the past?

Given he's currently serving an ICO there is a likelihood of a prison term. Recommend you get onto a lawyer.

It was common assault that he was charged with, part of an AVO as well. The only convictions he has had in the past was the ones that he has the ICO for. They were 3 aggravated break and enters and driving in a manner that was dangerous. He is going to plead not guilty to the common assault charge but as the police said he tried to strangle the person (5 times in fact) so anything that was done after that would be self defense Im guessing.
