The kindergarten has recently installed a new swing in their playground. It is shaped like a tyeare with criss-cross rope in the middle. It had been installed directly over the top of 2 "safe landing ground blocks" that have a gap of approximately 15-20cm between them. my son was attempting to get off when a student had slowed it right down. His foot became lodged in that gap, the swing then knocked him over causing a severely broken (Spiral break) of his right Tibia. Wondering what the Kindergartens responsibilities are?

On what you have said, the kindergarten is at least significantly responsible for thus terrible injury. Possibly the installers of the equipment too.

If you want kegs redress, see a personal injury solicitor.

But raise in strong terms, the injury and how it happened, with the kindergarten. They should and might act properly and ethically and at the very least reimburse you for the medical expenses.

I am currently awaiting the Dept of Educations investigation report, hopefully then, i can decide on which way to go.
Being a public patient the costs are very minimal at this stage. Have had to pay for hire of a wheelchair though.
My issue is that their is no way of knowing the long term effects of such an injury. I do know that my son is suffering psychologically, i realise it is still quite fresh but, the emotional trauma is very upsetting. He talks, calls out in his sleep and thrashes about. It is clear that it is a result of the occurrence in the Emergency Dept.

The EducationDepartment have just notified me that there was a breach in the law. What happens now.
