I had my retarded elder brother removed as guardian of my mother (for various reasons). She subsequently died in hospital while I was not there. I'm wondering who can sign a DNR? I know I didn't, and given my elder brothers state of mind, I wonder if the hospital deferred to him as next of kin?

Ask the hospital to provide copies of your mother's records. You may have to make an FOI application.
