My mother and my father purchased a granny flat from their superannuation and put in on me and my husband's property. The marriage isn't working and I stay because of my parents.

What are my parents' rights with their property as it's on our property? Can he just kick them out because it's on his land? It's all they have as they brought it with their superannuation.

They have no rights to the land, only their flat. Generally in this situation they have no entitlement to stay where they are simply because they own the granny flat itself, unless you drafted some sort of lease or licence agreement with them, you would have to see the term of that out.
