I’m seeking guidance on behalf of a friend who has been impacted by what appears to be an unfair redundancy.
He recently returned from paternity leave and had been open about needing flexibility to care for his young family. Shortly after, his role was made redundant. However, the job title and description were simply changed, and another individual—who is significantly less experienced—was appointed into what is essentially the same role.
When questioned, the company claimed the position had become a "senior role" and implied my friend lacked the required experience. Yet, the individual who was appointed is notably junior and less qualified. There are concerns that race and background may have played a part, as the appointed individual is Anglo-Australian and my friend is not.
He feels targeted and unfairly treated.
Where can he go to seek justice or support?
Are there legal avenues to challenge this kind of redundancy, especially if it's masking discrimination?
Would appreciate any advice on how employment lawyers might help or if there's a government body where he can raise a complaint.
