Hi Rod,

In my opinion, there is a gap in the Privacy Act 1988 since it does not protect rights such as physical and communication rights, which increase the bargaining power imbalance between consumers and digital platforms that perform poor data practices. Big tech companies at the moment can monitor a person’s search on the World Wide Web and use the information for their own commercial interests, such as marketing and SPAM. It is questionable, whether or not, this information should only be used and collected with the consent of the individuals. So they can easily disrupt the privacy of individuals.

Your original question relates to tort law. You should discuss the status of a tort of privacy.

You need to consider that people do not pay to use many of the services of the big companies so how are big tech companies supposed to derive income.
