Final orders approx 2 years old. Parent 1 regularly breaches but not serious enough to warrant filing a contravention. Orders state passport is to be applied for and held by the court. When parents wish to use they met requirements set out in orders. No taking child to non Hague convention country without other parents permission. Parent 1 has been issued the passport but refuses to admit to parent 2. Parent 1 refuses to surrender to court house for holding in accordance with court orders. Parent 1 is not an Australian citizen. Parent 1 is discussing taking the child to a non Hague convention country for a 'holiday'. Parent 2 advised parent 1 of intended travel in accordance with the orders but parent 1 refused to hand over the passport.

If Parent 2 files a contravention and asks for orders to be amended so that Parent 2 holds the passport at all times, is this likely to be granted based on Parent 1 behaviour?

If Parent 1 does attempt to leave the country with the child what ramifications would there be, if any?
