Hello, we are 4 siblings and our mother died in Sept 2016.
The sole executor who is also a beneficiary (our estranged brother) has been living in my mums house since he was born (he is over 50 now, unmarried and owns 2-3 properties outright and is financially sound)
Probate hasn't been applied for nor granted and there is a will dispute in progress
My question is - is he allowed to be living in the house if the terms of the will are not in effect? I was told by someone that this is maladministration as he is using the house for personal use as the executor but wanted some sound legal advice first
The law firm we have hired is hopeless so I have resorted to an online forum.
Can we legally have him removed from the house? And what is the process to do so?
