We are separated, living under one roof but we have not reached the 12-monthth mark. Are we able to finalise a legally binding property settlement before a divorce application?

Yes - you have 12 months from the time the divorce is finalised to get assets sorted. You can do it after that but only if the court grants special permission.

Really divorce only impacts stuff like your ability to re-marry and what happens to your estate if you die. So don't die until you're divorced... And even then it is better to have a will to make sure.

Getting it done prior to divorce has some merits, it is just another step in the process.
