Hi,
Can someone tell me, I own a commercial building that is currently vacant. The tenants of the buildings next door are constantly parking on my property and i'd like them to stop. I have issued verbal and written warnings for parking to cease, but it has not. As long as I have "NO PARKING" signs up, am I legally entitled under property law to have them towed from the area?

What is stopping you putting up a simple barrier
(chain, road barriers, a bit of hi-viz mesh, whatever)
across the entrance to your land?

there isnt a spot to put up mesh etc. the edge of our land is actually the start of council footpath. its not possible to put barriers on it.
we are actually selling the property and having 20 cars parked in the driveway doesnt do very well from a selling point. it also means its that if we put barriers up, it looks scrappy. ....

Most of the stuff you will see written about trespass parking on private land
is about parking on the common property in strata schemes.
None of that applies to you, because you are not in one.

I am not convinced that as a landholder, not being a strata,
you have any right to tow away any vehicle on your land
that is not yours.
