( car is Subaru Forester XT Turbo 2008 model)

i bought a car from a private seller that was out of rego for 12 plus months under the knowledge that all it needed was a new battery.
once arriving at the place i placed the new battery in the car and then had a mechanic come out and have a look as it didnt not start. He said that we chould replace the fuel pump as well and so the next day we did and it still did not start. so we towed it to the mechanic and he said it is a blown head gasket as well as the heads and it is going to cost $8000.00 to replace the whole engine as it is a sealed content and also to fit it into the car.

we asked for the m oney back as we never knew this and they refused.
i want to now take then to court under misleading information to get the money back that we paid for it which was $5000.00

where should i go and do i have a case?
