My son and his partner have a mortgage on a house in both names, she has decided to live there and pay the mortgage payments. He paid the deposit on the house for the mortgage. What rights does he have in the property now thats she is paying the mortgage?

It is his house as much as it is her's. Look things are messy. houses are covered under property law, contract law, family law and potentially criminal law...
So he may have equal rights to ownership of the property... All good, but if she is paying the mortgage, then he may not be meeting his obligations under contract law?

So short answer to your question is IT DEPENDS - what rights do you want him to have? and what obligations?
