I bought a pushchair on Gumtree and my hubby came home the next day and he says he has ordered a new one for me. I called the seller to refund my money back but he refused saying it is private. I need a solution under Australian Consumer Law.

There is none under consumer law as they are not a retailer. Buyer beware when buying private, they are under no obligation to refund money to you since you changed your mind and not even required to if it was faulty, as long as there was no deceptive practice on their behalf. You will have to on-sell it yourself on gumtree or similar.
