I'm hoping someone could point me in the right direction.

A friend of mine spent a significant amount of money on a car from QLD that was advertised on gumtree. The seller sent numerous text messages confirming there was nothing wrong with the vehicle, it was perfect. Now the vehicle has arrived. I'm in Melbourne.

It's quite obvious the photos were old as the car has rust holes straight through the floor. The gearbox is actually snapped off and it doesn't even have door handles.

Are there any legal steps under Australian Consumer Law to recover his money as the car was not as described?

As the car was purchased privately you are unfortunately not covered under the Australian Consumer Law.

You could try and get your money back in the magistrates court due to misleading and deceptive conduct.
