Hi everyone,

I was just wondering how to establish a conflict of interest for representation.
For example if a solicitor of a firm was to represent a client who was opposing the direct family of a former client, would that be a conflict of interest?

Thanks,
Laura

Not necessarily...your/your families current lawyer would be able to tell you. The Law Society of NSW has a couple of papers/reports you might also be interested in having a look at (if you want to read up a bit more about conflicts of interest yourself). You can find the ‘papers and articles’, by scrolling down, here

I agree it is unlikely to be a conflict. The conflict needs to be with the former client, not other people related by blood to the former client.
