Hi everyone,

I was just wondering how to establish a conflict of interest for representation.
For example if a solicitor of a firm was to represent a client who was opposing the direct family of a former client, would that be a conflict of interest?

Not necessarily...your/your families current lawyer would be able to tell you. The Law Society of NSW has a couple of papers/reports you might also be interested in having a look at (if you want to read up a bit more about conflicts of interest yourself). Oh, i was going to come here and say that the best way for 'establishing conflicts' is to get married!!! :)

I agree it is unlikely to be a conflict. The conflict needs to be with the former client, not other people related by blood to the former client.
