I exchanged on a property in NSW and released the deposit. My financier declined to settle due to undefined adverse circumstances and my deposit was forfeited. I subsequently discovered that the property was exchanged before I had exchanged, also on a released deposit and was due for settlement after my contract was terminated.

I understand misleading and deceptive conduct by the vendor. However, anything else?
