Hi,

Does anyone know if it's possible to have a solicitor represent you for a diversion hearing? For example, if you were unable to go.

I have represented clients at diversion hearings however they need to be present to appear before the Magistrate and sign diversion papers.

So it's black and white? The accused needs to appear regardless of circumstances?

Unless out of Victoria which would mean dealing with it in a different manner.

Tony, thanks for your replies. If the accused was out of the country genuinely because they no longer held a valid visa and would risk becoming illegal, therefore detained and deported, would there be leeway?

I believe so. Documents could be emailed for signing and returning.

Ok, if I was to contact the court directly dealing with the matter would they be able to confirm that? I have spoken to a solicitor and he cannot confirm if that was possible or not.

Depends who you speak to. Like everything you need to deal with the right person.
