My sister recently passed away, without leaving a will, whilst on a one week holiday at our parents. She had five children at the time she was not declaring her relationship with her partner of nine years. Now our parents have disrespected her wishes and kept her three oldest children in Narrogin, the two youngest with their biological father in Geraldton (custody of children). At this point in time my parents will not let the children communicate with anyone previously involved in their lives including their siblings. What can I do under family law to prevent them from doing this?

Do all the children have the same biological father?
If yes he is the guardian. What is his position?
