Following mention day for a peace and good behaviour application, myself (plaintiff) and defendant were told that mediation will not be effective. The case has been referred back to the civil court and I am unable to attend the second mention due to work issues.

Can I send an email to inform the magistrate I intend to take the case to a hearing if the defendant does not agree to the accusations?

Sometimes this is possible. I would call the registrar at the court or else the Magistrate or their assistant to discuss it with them.
