I have a Civil Claim for 'debt' in the Magistrates Court.
The defendant, in their filed Defence of the Claim, has knowingly made a false statement which I can prove to be false via documentation.

The question being, does that false statement represent 'perjury' or does it need to get into the Court hearing before being deemed as such?

I am trying to decide whether or not to address this at the Settlement Conference or wait until it gets to a hearing.

Strategy wise, if brought up at the conference, I am concerned the Defendant may seek to change that statement/defence and then I could lose the advantage it presents if the matter goes forward. Alternatively, would bringing it up at this point force the defendant to reconsider just submitting to the Claim.
