My car was hit by this drunk driver at 3am last week. My car was later declared repairable written off and my insurance company paid me some money which was not enough to cover the value of the car. I am not on comprehensive insurance and the claim from my insurance company was very limited. This drunk driver is getting difficult to be contacted and is reluctant to handle this matter in an urgent sense. I have got the below information or documents:

Queensland Police report number

This driver’s contact details & license

Record of my insurance claim

Written off vehicle report

Quotation of fixing my car from my insurance company

I have tried many time contacting this third party driver but still there is not much progress. What should be my next step?

what is the car worth? conservatively, what would you have gotten if you sold it second hand - prior to the crash?

I hate to say it but I think you're on a hiding to nothing... See you could try and make him pay, threaten court etc... But the stress and expense if you hire a solicitor - just not worth it..
