I bought a new car in June that cost about 45 000 and now since Nov it has been towed 4 times and they never seem to be able to fix it.

How long is classed as "too long" under Australian Consumer Law before they have to replace the lemon car if they can't fix it?

Hi Stephen169,

Generally, consumers of products that are not of merchantable quality are entitled to a refund or replacement when there is, a "major failure". This is defined as when a reasonable consumer would not have bought the motor vehicle if they had known about the full extent of the problem. For example, no reasonable consumer would buy a new car with so many recurring faults that the car has spent more time off the road than on it because several mechanics have been unable to solve the problem.
