My sister is 15 and pregnant and her boyfriend is 20. I need to know if he can go on the birth certificate without getting done for statutory r**e under criminal law.

If you are wanting to protect the guy I wouldn't recommend it.

Authorities have access to the birth certificates. Once someone finds themselves in the legal system for something like this it can be hard getting out again without significant cost and penalty.

I can understand some cases where a guy can have the mental age of a 15/16 year old but be 20, however the law is willfully blind to these circumstances.

The age of consent in Australia is generally 16. Therefore it is a crime for anyone to have sex with someone under 16 years of age. Persons who have sex with children under the age of 17 commit r**e and can be charged, jailed and placed on the sex offender register.
