Issuing body: Police pulled over and via mail

Current Drivers Licence Details/ relevant restrictions and/or history: Open License

Alleged Offense: Driving unregistered / uninsured

Ticket issued: Yes

Details: So, my partner moved house and updated her address with QLD transport, but it must have been after they sent her Rego Renewal notice, as it never arrived and her car has been unknowingly unregistered for the last month.

She got pulled over by the police last week, and got the relevant fines for driving unregistered/uninsured, which sucks, but I totally understand that it's her fault for not being on top of her rego. She went straight to QLD transport and sorted rego out as soon as she realised.

She's now received another set of fines in the mail from 3 weeks earlier, for driving unregistered/uninsured - from an ANPR camera on the Bruce Highway at Narangba, that can detect number plates and issue fines.

The ANPR offense occurred on 9/1/16, was processed on the 21/1/16 and fine arrived approx 28/1/16 (after her traffic stop fine - 25/1/16).

It's the same offence but has occurred on a separate occasion. I'm wondering whether she has any chance of getting out of this earlier fine under Traffic Law? Or whether she'll be getting slugged with the $800 fine for every time she's driven past this traffic camera (approx 3-4 times)?

I know it's her fault for not having rego sorted, but 3 weeks to process ANPR fines seems like a long time. If she had received this sooner, rego would have been sorted immediately. Now I'm wondering if she's looking at $3-4000 in fines?

I would write to QLD Transport or the issuing authority on the camera ticket and see if they will exercise leniency or alternatively go through the relevant appeal process. You are not trying to argue that it didn't occur but for them to exercise leniency since she rectified the issue immediately upon realising that she was unregistered. Does she have an otherwise good driving record?

Yes. Her record otherwise is very good. One other minor speeding ticket a few years ago, and that's all.

That was the advice from Queensland transport also, so we'll see how that goes.
