Hello, all I'm posting this on behalf of my friend. She is not Australian and she is not living here but her brother lives here. Someone made a fake Facebook account and using her name and photos, so can her brother or me put a claim against that person? Or will the ACORN investigate for a victim who is not Australian and not living in Australia?

And we believe the suspect lives in Australia as I know him and his real profile on Facebook but he said that is not him I'm not 100% sure if that's him.

Thanks

She would have to bring the action since it is her character that has been impersonated and the photos used belong to her (ie copyright infringement).

If her brother provides evidence like some family photos, including his' and his sister, is that going to help?

It might help, but it's still her that has to bring the action.
