Hello,

Im about to get a friend to serve my ex wife the divorce, however i have noted in the application it has my family name.. She has not changed her name to my family... will this be a problem? And does anyone know how this can be fixed..

Contrary to popular belief, marriage does not actually require a woman to do anything for a name change to be applied. Instead, marriage just gives her a choice about which name to use. I, for one, am known by my married name to most institutions - banks, super fund, university, work, etc. - but by my maiden name on my former lease (only because changing my name on the lease was a very painful process).

So, insofar as I'm aware, the name error on the divorce application should be of no consequence.
